When an Artist Actually Starts Seeing Money"},"content":{"rendered":"<p>Recoupment is the process by which a record label or financier earns back, from the artist&#8217;s royalty share, the money the label invested upfront before the artist starts receiving royalty payments.<\/p>\n<p>The label pays the artist an advance. The artist&#8217;s share of revenue then flows to the label, not the artist, until the label has recovered the advance and any recoupable costs. Past that point (the recoupment threshold), the artist starts seeing money from each new sale or stream.<\/p>\n<p>This guide is for any artist considering a label deal, a distribution advance, or a label-services agreement and trying to understand what they are signing.<\/p>\n<h2>What is recoupment?<\/h2>\n<p>When a label offers an advance, that money is not a gift. It is a prepayment of royalties the artist would have earned anyway, plus a finance fee in some structures.<\/p>\n<p>Until the label recovers the prepayment from the artist&#8217;s royalty share, the deal is &#8220;unrecouped.&#8221; Once recovered, the deal is &#8220;recouped&#8221; and ongoing royalties flow to the artist.<\/p>\n<p>The mechanics:<\/p>\n<ul>\n<li>The label advances the artist a sum (the <strong>advance<\/strong>), say $50,000.<\/li>\n<li>The label spends additional money on the project (the <strong>recoupable costs<\/strong>): producer fees, mixing, mastering, video budget, tour support, marketing campaigns.<\/li>\n<li>The combined sum sits in a virtual account: the <strong>recoupment balance<\/strong>, say $200,000 total ($50,000 advance plus $150,000 recoupable spend).<\/li>\n<li>As the release earns, the artist&#8217;s contractual royalty share is applied against the recoupment balance.<\/li>\n<li>When the balance reaches zero, the artist&#8217;s share flows out as cash.<\/li>\n<\/ul>\n<p>Recoupable costs vary by deal. In a traditional label deal, almost everything is recoupable. In a label-services or distribution-advance deal, recoupable costs are typically capped at the cash advance plus a defined set.<\/p>\n<h2>Why does recoupment exist?<\/h2>\n<p>Because labels are financiers as well as marketers. The advance is risk capital: the label fronts cash so the artist can make and promote a record without personal capital. The label takes the risk that the record might never recoup. The artist takes the trade of giving up royalty cashflow during the recoupment period.<\/p>\n<p>For many artists this is a good trade. An advance lets them quit their job, hire a producer, fund a tour, and focus full-time on the project. For others it is a bad trade because the album underperforms and the artist sits unrecouped indefinitely, technically earning royalties but never seeing any.<\/p>\n<p>Industry data is consistent on one painful number: a majority of major-label artists never recoup. The traditional deal is engineered around the assumption that the hits subsidise everything else, and most signings do not turn into hits.<\/p>\n<h2>How does recoupment work in practice?<\/h2>\n<p>Two common structures.<\/p>\n<p><strong>Traditional record deal<\/strong><\/p>\n<ul>\n<li>Advance: $50,000 to multi-million depending on artist.<\/li>\n<li>Royalty rate: artist receives 10-20% of net revenue.<\/li>\n<li>Recoupable: advance, recording costs, video costs, tour support, half of marketing in some structures.<\/li>\n<li>Recoupment math: every $1 the label earns from your release, $0.10 to $0.20 chips at your recoupment balance.<\/li>\n<li>A $50,000 unrecouped balance against a 15% royalty rate requires roughly $333,000 of label-side gross revenue to recoup.<\/li>\n<\/ul>\n<p><strong>Distribution advance (modern indie-friendly structure)<\/strong><\/p>\n<ul>\n<li>Advance: $5,000 to $500,000+ for established indie artists.<\/li>\n<li>Royalty rate: artist receives 70-85% of net revenue.<\/li>\n<li>Recoupable: cash advance only, plus an explicit list of named services if agreed.<\/li>\n<li>Recoupment math: every $1 of net DSP revenue, $0.70 to $0.85 chips at your balance.<\/li>\n<li>A $50,000 distribution advance against an 80% net-revenue share requires roughly $62,500 of DSP gross revenue to recoup.<\/li>\n<\/ul>\n<p>The distribution advance structure is dramatically faster to recoup because the artist&#8217;s share of each dollar is much larger. This is the trade modern indie distributors (ONErpm, EMPIRE, Symphonic, Stem, Believe, InterSpace Distribution) compete on.<\/p>\n<h2>What recoupment means for indie artists<\/h2>\n<p>Three working rules.<\/p>\n<p><strong>Read what is recoupable before you read the advance number.<\/strong> A $100,000 advance with $400,000 of additional recoupable costs is functionally a $500,000 hole. A $50,000 advance with $0 of additional recoupable costs is a $50,000 hole. The hole size matters more than the advance size.<\/p>\n<p><strong>Distribution advances recoup faster.<\/strong> If the choice is a $50,000 traditional deal at 15% versus a $50,000 distribution advance at 80%, the second one recoups roughly 5x faster on the same revenue and you start seeing money far sooner.<\/p>\n<p><strong>Cross-collateralisation is the silent killer.<\/strong> In a multi-record deal, a label can apply unrecouped balance from one album against revenue from a later album. A successful third record can be unrecouped because the first two were money-losers. Always negotiate against cross-collateralisation if you can.<\/p>\n<h2>Common recoupment mistakes and gotchas<\/h2>\n<ul>\n<li><strong>Conflating &#8220;earning royalties&#8221; with &#8220;receiving money.&#8221;<\/strong> You earn royalties from day one. You receive nothing until you recoup.<\/li>\n<li><strong>Signing without an itemised recoupable-costs list.<\/strong> Vague contract language lets the label apply marketing, tour support, and producer fees against your balance without limit.<\/li>\n<li><strong>Not auditing label statements.<\/strong> Royalty statements are notoriously hard to parse. Major labels have departments that produce intentionally complex statements. Hire an auditor every few years.<\/li>\n<li><strong>Forgetting publishing recoupment is separate.<\/strong> A traditional publishing deal also has an advance and recoupment, independent of the record-deal recoupment. Two unrecouped balances at once.<\/li>\n<li><strong>Ignoring the reversion clause.<\/strong> Some deals revert masters to the artist after a defined period or recoupment. Most do not. Read this carefully.<\/li>\n<li><strong>Assuming an unrecouped deal is uncollectable.<\/strong> Even if you never recoup the recording side, your <a href=\"\/blog\/glossary\/what-is-performance-royalty\/\">performance royalties<\/a> from your PRO and your <a href=\"\/blog\/glossary\/what-is-neighbouring-rights\/\">neighbouring rights<\/a> flow to you directly, unaffected by recoupment.
