Directly, into a collecting society.<\/p>\n<p>The agreement with SFP-ZAPA covers September 2024 through the end of 2026, <a href=\"https:\/\/www.filmweb.pl\/news\/Jest+porozumienie+z+SFP-ZAPA.+Netflix+wyp%C5%82aci+tw%C3%B3rcom+tantiemy-167771\">reported by Filmweb<\/a>. SFP-ZAPA director Dominik Skoczek said the first payments reach eligible recipients this year.<\/p>\n<p>It is the clearest test yet of the most aggressive creator-remuneration rule in the European Union. It is also narrower than the headlines suggest.<\/p>\n<h2>What Poland actually passed<\/h2>\n<p>CMO means collective management organisation: the body that licenses a repertoire in bulk and pays the money back to its members.<\/p>\n<p>DSM means the Digital Single Market directive, the 2019 EU copyright law member states were supposed to transpose by June 2021. Poland was the last to do it, entering its amendment into force on 20 September 2024.<\/p>\n<p>That amendment rewrote Article 70 of the Polish Copyright Act. The result, per the <a href=\"https:\/\/www.saa-authors.eu\/articles\/the-most-inspiring-legislative-changes\">Society of Audiovisual Authors<\/a>, is an &#8220;unwaivable and inalienable right to remuneration for the on-demand (streaming), online uses (user generated content platforms) and retransmission,&#8221; to be &#8220;paid by the platforms and managed collectively.&#8221;<\/p>\n<p>Read those three phrases separately.<\/p>\n<ul>\n<li>Unwaivable: the creator cannot sign it away, even inside a full buyout contract.<\/li>\n<li>Paid by the platforms: the streaming service funds it, not the producer.<\/li>\n<li>Managed collectively: it moves through a CMO, not through the artist&#8217;s own deal.<\/li>\n<\/ul>\n<h2>The boundary nobody mentions<\/h2>\n<p>Article 70 governs audiovisual works. Films and series.<\/p>\n<p>A composer who scores a Polish series is a co-author of that audiovisual work and sits inside the statutory right. The same composer, releasing an instrumental single the following week, sits outside it.<\/p>\n<p>There is no equivalent unwaivable streaming royalty for recorded music in Poland. On a music DSP (digital service provider, meaning a streaming store), a Polish artist earns exactly what the distribution and label agreements say, and nothing more.<\/p>\n<p>Two rails in one country. One is statutory. The other is contractual.<\/p>\n<h2>The contractual rail is the bigger one<\/h2>\n<p>Poland&#8217;s recorded music market reached nearly 971 million zloty in 2025, up 14.2 percent year on year, moving the country to 16th in the global IFPI ranking, <a href=\"https:\/\/zpav.pl\/aktualnosc.php?idaktualnosci=2181\">per ZPAV<\/a>, the Polish record industry association.<\/p>\n<p>Streaming accounted for 82.7 percent of that, roughly 802.6 million zloty, with 526 million coming from paid subscriptions.<\/p>\n<p>So the overwhelming majority of Polish music money arrives on the rail with no statutory floor beneath it. We covered the shape of that market in <a href=\"https:\/\/interspacemusic.com\/blog\/poland-is-a-top-16-music-market-growing-14-its-charts-are-almost-all-polish-rap-and-a-third-of-streams-are-free\/\">Poland as a top-16 market growing 14 percent<\/a>.<\/p>\n<p>Which makes the contract the entire game.<\/p>\n<h2>What Polish artists and labels should do this quarter<\/h2>\n<ul>\n<li>If you write for film or television, confirm your CMO registration actually covers on-demand use. Article 70 money only reaches registered co-authors.<\/li>\n<li>Treat a sync placement as two income streams now. The sync fee and the Article 70 remuneration are separate, and the second one cannot be bought out.<\/li>\n<li>On the recording side, use the new transparency right. Article 47(1) of the amended act requires annual reporting on revenue per type of use.<\/li>\n<li>Confirm an ISRC (International Standard Recording Code, the unique per-track identifier) on every master before delivery. Mismatched codes strand royalties in suspense.<\/li>\n<li>Lock writer, performer and producer splits before release date, not after the first statement.<\/li>\n<\/ul>\n<h2>Why this matters beyond Warsaw<\/h2>\n<p>The Society of Audiovisual Authors is <a href=\"https:\/\/www.saa-authors.eu\/articles\/open-letter-extend-the-polish-model-of-statutory-remuneration-for-audiovisual-authors-to-on-demand-usages\">campaigning to extend the Polish model<\/a> to other member states. If it spreads, the gap between protected audiovisual money and unprotected music money widens across Europe.<\/p>\n<p>The same asymmetry runs through the region. We tracked it in <a href=\"https:\/\/interspacemusic.com\/blog\/romania-grew-faster-than-almost-any-market-in-europe-half-its-music-money-comes-from-radio\/\">Romania, where more than half of music income still comes from radio<\/a>, and in <a href=\"https:\/\/interspacemusic.com\/blog\/bulgaria-music-economy-tripled-25-million-euros-300000-pay-for-streaming\/\">Bulgaria, where only 300,000 people pay for streaming<\/a>.<\/p>\n<p>For a Polish artist the practical conclusion is unglamorous. The slice of your income with legal protection is the slice you may never earn. The slice you actually live on is the one your distribution agreement defines.<\/p>\n<p>That puts the weight on terms an artist can read: per-territory reporting, transparent split handling, and a delivery map that reaches the paying subscribers who generate 526 million zloty a year.<\/p>\n","protected":false},"excerpt":{"rendered":"Poland music royalties now include an unwaivable streaming payment funded by the platforms, and Netflix signed on 27 July 2026.
