Cambodia’s music copyright clock ran out on the country’s most famous songwriter this year, and the streaming charts have not noticed.<\/p>\n

The Apple Music top songs feed for Cambodia<\/a> on 18 August 2026 had VannDa’s “BLUE STORY” at No. 4 and GMENGZ’s “PEM PEM” at No. 5. At No. 25 sat \u1785\u17c6\u1794\u17c9\u17b8\u179f\u17c0\u1798\u179a\u17b6\u1794, credited to \u179f\u17ca\u17b8\u1793 \u179f\u17ca\u17b8\u179f\u17b6\u1798\u17bb\u178f, Sinn Sisamouth, who has been dead for half a century.<\/p>\n

Sisamouth, the singer and composer known as the king of Khmer music, is generally recorded as having died in June 1976 under the Khmer Rouge. The New York Times Overlooked obituary, summarised by Yale’s Southeast Asia Studies council<\/a>, says he was presumably executed and the circumstances remain unknown.<\/p>\n

Article 30 does the math for you<\/h2>\n

Cambodia’s Law on Copyright and Related Rights<\/a> is blunt. Article 30 protects economic rights “during the life of the author, and the whole 50 (fifty) years following his\/her decease.”<\/p>\n

Article 53 gives performers and phonogram producers 50 years from fixation or publication. Every golden-era master cut between roughly 1955 and 1975 crossed that line before 2026.<\/p>\n

So on a plain reading of the statute, the compositions leave protection in Cambodia during 2026, and the recordings left years ago. No ministry list has been published saying so.<\/p>\n

The 73 songs that made it back<\/h2>\n

Khmer Times reported<\/a> that the family submitted 181 songs for protection and that the culture and commerce ministries granted ownership of 73 of them to his widow Khao Thorn Ngot and his son Sinn Chanchhaya.<\/p>\n

That leaves more than a hundred songs that never got a ruling, in a catalogue his son has said runs to thousands.<\/p>\n

The evidence problem is physical. The Cambodian Vintage Music Archive<\/a>, a US nonprofit founded in 2010, digitises collectors’ vinyl and supports golden-era families “by assisting them to obtain intellectual copyright control.” The Phnom Penh Post has put the surviving golden-era archive at 5,520 songs<\/a>.<\/p>\n

One society, and a law in the middle of a rewrite<\/h2>\n

Cambodia entered the 2023 WIPO-ASEAN collective management survey<\/a> with one participating society: the Cambodian Music Collective Society, CAMCOS, for musical works. No sound recording society, no performers society. Malaysia, Thailand and Vietnam fielded all three tiers.<\/p>\n

The Prakas of 5 July 2016 requires any recognised CMO to file quarterly and annual reports with the Ministry of Culture and Fine Arts, which can suspend or annul recognition if irregularities appear.<\/p>\n

The underlying law is now open. On 19 September 2025 the ministry and the Bar Association of the Kingdom of Cambodia gathered input on amendments<\/a> intended to close enforcement gaps and match international treaties. Cambodia acceded to the Berne Convention only in March 2022.<\/p>\n

DataReportal’s Digital 2026 report<\/a> counts 12.0 million internet users in Cambodia at the end of 2025, 67.3 percent penetration, and 14.0 million social media identities. The market underneath all of this is not small.<\/p>\n
