Nh\u1eefng \u0111\u00f3ng g\u00f3p nh\u1ecf, ho\u1eb7c nh\u1eefng th\u1ecfa thu\u1eadn m\u00e0 c\u00f4ng s\u1ee9c l\u1eadp b\u00e1o c\u00e1o v\u01b0\u1ee3t qu\u00e1 doanh thu, c\u00f3 th\u1ec3 \u0111\u01b0\u1ee3c mi\u1ec5n \u00e1p d\u1ee5ng.<\/p>\n<p>T\u1ea1i \u00dd, theo <a href=\"https:\/\/www.taylorwessing.com\/-\/media\/taylor-wessing\/files\/germany\/2023\/the-dsm-copyright-directive-in-action---a4.pdf\">b\u1ea3n \u0111\u00e1nh gi\u00e1 so s\u00e1nh lu\u1eadt qu\u1ed1c gia c\u1ee7a Taylor Wessing<\/a>, vi\u1ec7c kh\u00f4ng cung c\u1ea5p b\u00e1o c\u00e1o l\u00e0m ph\u00e1t sinh suy \u0111o\u00e1n r\u1eb1ng th\u00f9 lao kh\u00f4ng th\u1ecfa \u0111\u00e1ng, v\u00e0 c\u01a1 quan qu\u1ea3n l\u00fd truy\u1ec1n th\u00f4ng c\u00f3 th\u1ec3 ph\u1ea1t t\u1edbi 1 ph\u1ea7n tr\u0103m doanh thu.<\/p>\n<h2>L\u1ed1i tho\u00e1t kh\u1ecfi m\u1ed9t th\u1ecfa thu\u1eadn b\u1ecb b\u1ecf x\u00f3<\/h2>\n<p>Article 22 cho ph\u00e9p t\u00e1c gi\u1ea3 ho\u1eb7c ng\u01b0\u1eddi bi\u1ec3u di\u1ec5n thu h\u1ed3i to\u00e0n b\u1ed9 ho\u1eb7c m\u1ed9t ph\u1ea7n quy\u1ec1n \u0111\u00e3 c\u1ea5p ph\u00e9p \u0111\u1ed9c quy\u1ec1n ho\u1eb7c chuy\u1ec3n nh\u01b0\u1ee3ng khi &#8220;kh\u00f4ng c\u00f3 ho\u1ea1t \u0111\u1ed9ng khai th\u00e1c&#8221;. Tr\u01b0\u1edbc ti\u00ean, b\u1ea1n ph\u1ea3i th\u00f4ng b\u00e1o cho b\u00ean n\u1eafm gi\u1eef quy\u1ec1n v\u00e0 \u1ea5n \u0111\u1ecbnh th\u1eddi h\u1ea1n. Ri\u00eang \u0111i\u1ec1u l\u1ec7 c\u1ee7a SGAE cho ph\u00e9p th\u00e0nh vi\u00ean <a href=\"https:\/\/interspacemusic.com\/blog\/sgae-partial-withdrawal-24-rights-categories-spain\/\">r\u00fat t\u1eebng nh\u00f3m quy\u1ec1n m\u1ed9t<\/a>.<\/p>\n<p>Article 47 b\u1ed5 sung m\u1ed9t th\u1eddi h\u1ea1n th\u1ee9 hai: n\u1ebfu th\u00f9 lao \u0111\u00e3 th\u1ecfa thu\u1eadn r\u00f5 r\u00e0ng kh\u00f4ng t\u01b0\u01a1ng x\u1ee9ng v\u1edbi doanh thu v\u1ec1 sau c\u1ee7a b\u00ean nh\u1eadn chuy\u1ec3n nh\u01b0\u1ee3ng, t\u00e1c gi\u1ea3 c\u00f3 10 n\u0103m k\u1ec3 t\u1eeb khi chuy\u1ec3n nh\u01b0\u1ee3ng \u0111\u1ec3 y\u00eau c\u1ea7u th\u1ea9m ph\u00e1n \u1ea5n \u0111\u1ecbnh m\u1ee9c th\u00f9 lao c\u00f4ng b\u1eb1ng.<\/p>\n<h2>V\u00ec sao ph\u1ea7n l\u1edbn ngh\u1ec7 s\u0129 ch\u01b0a bao gi\u1edd s\u1eed d\u1ee5ng quy\u1ec1n n\u00e0y<\/h2>\n<p>H\u00e0 Lan \u0111\u00e3 c\u00f3 c\u00e1c quy \u0111\u1ecbnh t\u01b0\u01a1ng t\u1ef1 t\u1eeb n\u0103m 2015.
