Meta\u2019s planned business terms could let it use content from business account holders without offering an opt-out, according to the Copyright Alliance.<\/a> Separately, Spotify\u2019s potential liability in The Mechanical Licensing Collective\u2019s audiobook bundling lawsuit has reached roughly $619 million.<\/a> One issue concerns permission to use content; the other concerns a disputed treatment of a subscription bundle. Both give independent rightsholders a reason to examine what their platform agreements actually cover.<\/p>\n

Find the permission point<\/h2>\n

The phrase to examine in the Copyright Alliance\u2019s objection to Meta\u2019s planned terms<\/a> is \u201cwithout offering an opt-out.\u201d If an account holder cannot refuse a proposed use while keeping the account on the same terms, the platform controls a decision that the rightsholder might otherwise make separately. For a label, that decision may concern material posted through its business account as well as material it owns or administers. Those are questions for the label\u2019s own records: who posted each item, who holds the relevant rights, and what authority the account holder has to accept terms covering it.<\/p>\n

The financial mechanism is a lost opportunity to negotiate. Where a use would otherwise require a separate permission, a term granting that permission through the account can remove the occasion to set a price. That does not assign a value to every post. It tells the rightsholder which decision to review before accepting a change: whether the account\u2019s operator can grant the proposed permission for all the content the account carries.<\/p>\n

A small label may run one business account for recordings it owns, releases it distributes, and promotional material supplied by others. The account login does not answer the rights question for each item. The useful check is an inventory tied to the underlying agreements. Mark which content the label can license itself, which requires another party\u2019s consent, and which should be taken through a separate approval process before anyone accepts new platform terms. The point is to identify the person entitled to make the decision while that decision is still available.<\/p>\n

Keep bundle treatment on the royalty ledger<\/h2>\n

The Mechanical Licensing Collective\u2019s lawsuit over Spotify\u2019s audiobook bundling carries roughly $619 million in potential liability.<\/a> That figure identifies the scale of a disputed claim. It is not a royalty rate an independent label can enter into its next forecast, and it is not a payment allocated to any particular catalogue.<\/p>\n

The mechanism differs from a content permission. A bundle groups offerings under a subscription. The dispute concerns how Spotify treats that bundle for mechanical royalty purposes. A rightsholder assessing its catalogue needs to follow the payment question from the subscription classification to the royalty statement, rather than treating the subscriber price alone as proof of what a musical work earned. The immediate decision is whether its accounting can isolate mechanical income from other catalogue receipts so that any later adjustment can be identified.<\/p>\n

That distinction matters when a team budgets against a claim still in litigation. AI licensing, streaming fraud and mechanical royalty disputes ask different questions of a catalogue and require separate rights and payment records.<\/a> Put the Spotify bundle issue on the mechanical royalty ledger. Record the periods and works a team may need to reconcile, then keep a disputed recovery out of the ordinary income forecast until there is an amount attributable to those works. A headline claim against a platform cannot substitute for that allocation.<\/p>\n

Use a separate test for each change<\/h2>\n

A single platform file is unlikely to answer both questions. The Meta issue starts with authority to permit use of content. The Spotify issue starts with the classification and accounting of a paid service. An independent team can make those checks concrete:<\/p>\n
