Malaysia’s songwriter royalty clock depends on what is missing. Music Authors’ Copyright Protection Berhad (MACP) holds an identified nonmember’s share for up to three years. An unidentified song can be paid to other writers at the next distribution if nobody claims it in time. Those are different problems, and a distributor’s streaming statement alone solves neither.<\/p>\n

Three years applies to an identified nonmember<\/h2>\n

MACP is the society that administers songwriters’ and publishers’ rights in Malaysia. Its November 2024 distribution policy<\/a> says a share on a MACP-originated work belonging to a composer, lyricist or publisher who is not a member goes into a nonmember special account. It is held for up to three years and released if that party joins during the period.<\/p>\n

If the writer does not join, the policy says that share is returned to the distribution pool in the fourth year’s distribution. It goes proportionally to parties receiving royalties in that year’s category. The policy also says no interest accrues on the held share.<\/p>\n

Consider a locally registered song with two equal writers. If one is a MACP member and the other is not, the registered writer may receive their portion while the other portion waits. MACP’s FAQ<\/a> tells members to register the work with both ownership shares, and says the co-writer must join MACP or an affiliated society to receive theirs.<\/p>\n

That is a rights-administration deadline, not a promise that every song will generate money. The size of any share depends on licensed uses, the correct work registration and MACP’s allocation rules. An independent label should ask who is administering each writer’s share before it distributes the recording.<\/p>\n

An unidentified song has a shorter decision point<\/h2>\n

The same policy has a separate credits in suspense<\/em> account for uses MACP cannot match to a documented work. If the work is identified before the next distribution, the interested parties can be paid. Otherwise, the remaining money is returned to the corresponding category’s pool. MACP says members can inspect unidentified-song lists in MyKarya<\/a> and notify the society when they recognize a track.<\/p>\n

Do not confuse that process with the three-year nonmember hold. In one case, MACP knows the work and lacks an eligible member for a share. In the other, it lacks enough information to identify the work. The remedy for the first is membership or an affiliated society; for the second it is evidence that lets the society match the reported use.<\/p>\n

There is a third timing rule. For an older work newly registered by a member, MACP’s FAQ says it can credit up to one year of missed royalties retroactively, provided the music remains actively used in public and can be identified before the next distribution. That is conditional, not a blanket three-year back-payment right.<\/p>\n

Make the next distribution count<\/h2>\n

Start with a signed split sheet showing the song title, every writer’s legal name, publisher if any, and percentages totaling 100. Then have each writer confirm their society membership and register their own interest in MyKarya; MACP says each co-writer must register<\/a>, even when another writer has already entered the song. Check the portal’s work record after submission and review its unidentified list against your live and broadcast history.<\/p>\n

Keep the recording and composition ledgers separate. An International Standard Recording Code (ISRC) identifies the master recording; it does not enroll its writers with MACP. The distributor’s track-level statements can help reconcile titles and dates, but the writer’s society record decides whether a composition claim matches.<\/p>\n

For cash-flow planning, MACP’s policy targets digital distributions in March and November, general performing and overseas distributions in July, and concert distributions quarterly. Its minimum payment threshold is RM100 for a member; smaller balances roll into a later distribution. These are targets, so check the current schedule before forecasting a payment date.<\/p>\n

That check is more valuable than discovering an unmatched royalty on a statement months later.
