SAMRO\u2019s current distribution rules give rights holders three years from allocation to claim an undocumented performing-rights royalty.<\/strong> For a commercially released song, the claim must include its International Standard Recording Code (ISRC). A distributor\u2019s streaming statement is useful evidence of a recording\u2019s use, but it does not by itself settle who owns the composition.<\/p>\n

The Southern African Music Rights Organisation (SAMRO) rules approved on 18 February 2026<\/a> replaced an older rulebook that allowed five years to claim an undocumented allocation. The new rule is a catalogue maintenance deadline, not a fresh royalty rate.<\/p>\n

What starts the three-year clock?<\/h2>\n

The clock starts when SAMRO allocates money as an undocumented royalty, not when an artist uploads a track or a radio station plays it. \u201cUndocumented\u201d means SAMRO has assigned a royalty to a share of a work but cannot identify or verify the person entitled to that share. Its rules say an unclaimed allocation is added back to net distributable revenue after three years and paid through the next cycle.<\/p>\n

That distinction matters. An unreported play has no identified allocation to claim. Rule 6.8 gives a separate 36-month route, measured from the distribution statement date, for a rights holder who can prove a licensed user played a work but omitted it from its performance return. The rule expressly excludes foreign distributions from that route. Check whether your problem is an undocumented share, a missing play, or a payment-detail issue before filing.<\/p>\n

SAMRO\u2019s distribution guidance<\/a> says incomplete work notifications, missing splits and poor broadcaster or cue-sheet data can create undocumented works. Validation still takes place after a member submits a claim; finding a title in a database is not the same as receiving a cheque.<\/p>\n

Build the claim around the work and the recording<\/h2>\n

For a commercial recording, rule 12.2 requires an ISRC with each claim. An ISRC identifies a particular recording, while the claim concerns the song\u2019s performing right and its writers or publishers. The International ISRC Agency says a distinct mix needs its own ISRC<\/a>, even where the underlying composition is shared. Keep the ISRC for the actual version used alongside the title, writers and agreed percentages.<\/p>\n

SAMRO may request proof of control before payment. Its examples include Common Works Registration (CWR) files, a Comma-Separated Value (CSV) catalogue file, an International Standard Musical Work Code (ISWC), songwriter agreements, split sheets, broadcaster cue sheets, official digital service provider credits, and sync or commission agreements. These are possible evidence types, not a promise that any single screenshot will validate a claim.<\/p>\n

Start with a catalogue export that pairs every release\u2019s recording identifiers with the composition\u2019s writers and publisher. Ask co-writers to sign the split sheet before release, then compare that document with the work notification at SAMRO. The society says its member portal<\/a> lets members register titles, review statements, and search or update undocumented works. If a broadcaster omitted a performance, its support guidance asks for the work title, programme, station, date and, if possible, time.<\/p>\n

Do not mix up the royalty lanes<\/h2>\n

SAMRO administers performing rights in musical works. It is not the route for a distributor\u2019s master-recording receipts or South African needletime payments on a sound recording. Those separate lanes are explained in our SAMRO and needletime guide<\/a>. A label should reconcile all three records rather than assume one dashboard covers them.<\/p>\n

For a practical audit, sort your catalogue by release date and check every work that received South African radio, television, live or digital use against SAMRO\u2019s statement and work registration. Flag missing splits and unexplained gaps immediately, then record the allocation or statement date for each query. A distributor with clean ISRC records and transparent collaborator splits makes this audit easier. It cannot replace the songwriter\u2019s SAMRO registration.
