C\u00f4te d’Ivoire can require a copy-levy receipt before an imported phone clears customs, yet the 2026 international study of that levy cannot say how much it collected. That is the practical divide in the Ivorian system: the route from importer to collecting society is specified down to the paperwork, while the public route from collection to individual music rightsholders is much harder to see. This is a different question from our October examination of BURIDA’s September royalty round<\/a>, which concerned delayed distributions from several licensing lines.<\/p>\n

The Ivorian customs circular signed on 15 June 2022<\/a> says the private-copying levy is 3% of the customs value of specified imported media and devices. It also sets a separate 4% reprography levy for specified copying equipment. Importers must produce both a BURIDA declaration and a payment receipt for the applicable charge before customs will accept the declaration to release the goods. The money is collected by BURIDA, the Bureau Ivoirien du Droit d’Auteur, rather than paid into a general customs account.<\/p>\n

A phone is a point of collection, not a stream<\/h2>\n

Private copying is compensation for the legal ability to make personal copies of protected work. It is charged on eligible equipment or storage media, not on the number of times a track is played. That distinction matters to a label distributing into Abidjan. Delivery to a streaming store can produce recording income and, through separate rights channels, composition income. A phone import can create a third pot before the listener has chosen any song. It should not be counted as a streaming royalty or assumed to appear in a distributor’s statement.<\/p>\n

The annex to the 15 June 2022 customs circular<\/a> includes storage-capable mobile phones, memory cards, USB drives and other devices under the private-copying list. It also lists a mobile phone with a copying or reproduction function under the separate reprography schedule. That overlap is worth reading carefully. The published list establishes potential product classifications; it does not, by itself, prove that every handset is charged both rates. An importer needs the applicable classification and BURIDA assessment for the particular device. An artist should likewise avoid multiplying phone sales by a headline rate and calling the result unpaid royalties.<\/p>\n

The same circular’s specimen declaration shows why the distinction matters. It presents one line of storage devices at the private-copying rate and another line of printing equipment at the reprography rate, with separate calculations and a combined receipt. It is an illustration of the form, not a report of national receipts. The 2026 Private Copying Global Study<\/a> likewise distinguishes the two Ivorian schemes and says importers or local manufacturers declare the type and quantity of goods. For locally manufactured goods, the study describes the private-copying base as the ex-factory price rather than an import value.<\/p>\n

The collection mechanism is still being worked on<\/h2>\n

This is an operating system, not merely a clause waiting for regulations. In its own 2023 communication project brief<\/a>, BURIDA said it began collecting the two remuneration streams on 15 June 2022. The brief called for training customs staff, importers and rightsholders, and for adding collection and distribution functions to its internal software. Those were stated project needs in 2023, not proof that the software still lacked them in 2026.<\/p>\n

The customs authority reported on 11 November 2025<\/a> that it had opened a training session on both levies for its officers. In CINEWS’s report dated 28 March 2026<\/a>, a customs delegation visited BURIDA’s collection office in Treichville. These are narrower observations than an audited collection figure, but they establish that staff and a collection point were active years after the original circular.<\/p>\n

Customs enforcement gives this income line a different shape from radio or venue licensing. A broadcaster may owe for a programme of music; the importer has to resolve an eligible device’s levy at the border to complete the paperwork. BURIDA’s 2023 brief describes the receipt as a customs condition, and the customs circular says the same thing from the regulator’s side. That corroboration is useful. It confirms the collection route without telling us the annual total or the amount reaching any class of creator.<\/p>\n

The rightsholder’s share has a rule, but needs an account<\/h2>\n

The 2026 CISAC study<\/a> sets out the private-copying distribution key as 15% for administration, 5% for a special fund, 5% for the fund supporting culture and artistic creation, and 75% for rightsholders. Those are prescribed allocations, not evidence of what BURIDA paid in any given year. Music’s eligible classes are authors, performers and producers of phonograms or videograms. The reprography scheme serves a different pool, authors and publishers of printed, graphic and visual works, with the same stated overall deduction structure in the study.<\/p>\n

The distinction is commercial, not academic. A self-releasing singer may be both a songwriter and a performer, and may own the recording, but those are separate claims. A label may own a recording without owning the composition. A publisher may be relevant to the song but not automatically to the private-copying share for a particular recording. Before budgeting a share of the levy, each party needs to know which legal class it belongs to, what it has registered with BURIDA, and whether a mandate or reciprocal arrangement applies.<\/p>\n

There is a territorial qualification too. Article 103 of C\u00f4te d’Ivoire’s 2016 copyright law<\/a> says, subject to international agreements, private-copying remuneration is divided among authors, performers and producers of phonograms and videograms first fixed in C\u00f4te d’Ivoire. That wording does not mean every recording first made in Lagos, Accra or Paris receives an automatic Ivorian levy payment just because its audience uses Ivorian phones. The international-agreements proviso matters. Any cross-border claim needs to be checked through the applicable society mandate and repertoire documentation rather than assumed from a store’s country report.<\/p>\n

Nor is a levy on a device a transaction tied to a named track. The border receipt records the goods, value and charge, not a listening history. Distribution among creators therefore requires a method for assigning a pooled collection to eligible repertoires and rightsholders. The BURIDA project brief from 2023<\/a> explicitly identified a need for a software module handling both collection and distribution. The published material reviewed here does not establish whether that module was completed, what allocation data it now uses, or how much of the pool has been distributed.<\/p>\n

What the 2026 study does, and does not, tell us<\/h2>\n

The 2026 Private Copying Global Study’s C\u00f4te d’Ivoire entry<\/a> ends with a precise limitation: it received no detailed information on tariff setting and total revenues. It does publish the stated rates and legal distribution rules. Its missing total should not be inflated into a claim that BURIDA collected nothing, that funds were withheld, or that no public accounts exist elsewhere. It means this major comparative source cannot let a reader calculate the actual value of the Ivorian private-copying stream from its country profile.<\/p>\n

That missing denominator changes how a rights holder should read the 75% rule. Three quarters of an undisclosed collection is not an earnings forecast. A society could publish the aggregate levy collected, deductions by category, amount allocated to each rightsholder class, and the amounts actually paid or carried forward. Those are the figures that would turn a rule into an auditable revenue line. They would also let an importer see whether the receipts generated at the border translate into the creator compensation used to justify the levy.<\/p>\n

For now, the sound practical approach is to treat Ivorian private copying as a separate receivable to investigate, not as a guaranteed uplift to digital income. Ask BURIDA which author, performer or producer registrations apply to the catalogue; establish whether a reciprocal mandate covers a foreign rightsholder; then look for a statement that identifies private copying distinctly from broadcast, live use and ringback tones. On the evidence available in this run, C\u00f4te d’Ivoire has built a firm gate for collecting the levy.
