Benin has a private copying levy in a government decree, but its royalty system still does not have a documented route from that levy to a musician’s account. The gap is visible in the sources themselves. A decree dated 5 May 2015 names the payer, the rate, the collector and customs’ role. The 2026 Private Copying Global Study by the International Confederation of Societies of Authors and Composers (CISAC) and its partners<\/a> nevertheless places Benin among countries with a legal remuneration system but without collection and distribution mechanisms. Those statements can both describe the same market: a rule on paper and a payment operation are different things.<\/p>\n

For a label sending a catalogue into Cotonou, that distinction matters more than the existence of a levy headline. A levy may establish who should pay for private copying. It says nothing by itself about which importer has paid, which works qualify, how the proceeds are allocated between composers, performers and producers, or when anybody receives a statement. Benin’s unanswered business question is the route between those steps.<\/p>\n

What the decree actually provides<\/h2>\n

Benin’s copyright law, Law 2005-30 of 2006<\/a>, gives authors, performers whose performances are fixed on phonograms, and phonogram producers a right to remuneration for certain personal copies. Its articles 74 to 78 put the payment obligation on manufacturers and importers of relevant physical media, assign collection and distribution to the collective management body, and exempt exports and media not normally usable for private copying. These are rights and duties, not a receipt or a distribution statement.<\/p>\n

The government’s Decree 2015-247, dated 5 May 2015<\/a>, goes further. Article 2 describes blank recording media and devices capable of reproducing works. Article 3 sets a rate of 5 per cent of the cost, insurance and freight value of each blank recording medium<\/strong>. Article 4 identifies the Bureau B\u00e9ninois du Droit d’Auteur et des Droits Voisins (BUBEDRA) as the sole body authorised to collect. Article 5 permits customs to collect and transfer the money to BUBEDRA’s bank account. Article 6 directs BUBEDRA to return 10 per cent of amounts recovered<\/strong> to customs for operating costs. Article 7 still calls for a joint implementing order from the culture and finance ministers.<\/p>\n

Those details should stop anyone from flattening the story into \u201cBenin has no law\u201d. They should also stop a publisher from treating the decree’s percentage as an estimate of cash already entering the music economy. The base is a defined category of imports, not every phone sold in Benin, and the text alone does not establish that customs has begun collecting on any particular product. A rights holder cannot turn a statutory rate into a royalty forecast without the import base, the actual receipts and an allocation rule.<\/p>\n

Why the 2026 classification still says no mechanism<\/h2>\n

The CISAC-led study published in 2026<\/a> lists Benin under \u201cremuneration system but without collection and distribution mechanisms\u201d. Its Benin entry acknowledges the law and BUBEDRA, yet its overview marks tariffs \u201cNo\u201d. That last entry sits awkwardly beside the 2015 decree’s blank-media rate. The defensible reading is a discrepancy between a legal instrument and the study’s assessment of an operational tariff system. It is not evidence that the decree has been repealed, and it is not evidence that money has been collected and withheld. Neither source supplies a Benin private copying receipts series or a beneficiary payout table.<\/p>\n

Benin’s culture ministry’s account of its BUBEDRA reform<\/a> describes private copying as an expansion still to be opened. It lists work to inform customs and importers before collection begins, make a technical commission functional, publish annual accounting, and build a distribution system with technical assistance. The page does not give a completion date for those tasks, so it cannot by itself prove their status today. It does show why digitising ordinary copyright fee collection cannot be assumed to activate a separate private copying levy.<\/p>\n

The more recent public checkpoint is local reporting. In a 28 July 2026 account of a Cotonou workshop<\/a>, Beninese daily La Nation reported BUBEDRA director general Eug\u00e8ne Aballo saying that preparations for collection, documentation and distribution were under way. The report said participants were due to examine how BUBEDRA, customs and the Treasury would interact. That account describes implementation work, not a completed collection round. It independently supports the operational caution in the CISAC study while adding a later date and the responsible institutions.<\/p>\n

Private copying is a different account<\/h2>\n

On its public payment platform<\/a>, BUBEDRA tells venues and other users how to register, follow an account and pay copyright fees. It lists concert organisers, broadcasters, clubs and restaurants among the users covered. That is a useful collection interface, but the page does not identify a private copying tariff, import declaration, receipts total or payout timetable. The earlier InterSpace Daily piece on Benin examined this ordinary fee collection and the difficulty of joining the rights-holder register. This article examines a separate levy on copying media and the missing evidence of its passage through customs, BUBEDRA and distribution.<\/strong><\/p>\n

The distinction also matters to a distributor in Lagos or Accra. Delivery of a recording to a digital service provider (DSP) creates a platform reporting and payment path under the relevant distribution and platform agreements. A private copying remuneration scheme is a statutory path tied to copying media. The same recording may be relevant to both, but a DSP statement cannot confirm whether Beninese importers paid the levy, and a BUBEDRA user-payment portal cannot replace the DSP statement. For rights holders, these are separate accounts to reconcile.<\/p>\n

Benin’s statute also names three classes of beneficiary: authors, performers and phonogram producers. The 2006 law<\/a> says private copying remuneration is to be divided among those classes. A release’s distributor metadata identifies contributors and recording ownership for delivery, but it does not show how BUBEDRA will match an import-based pool to specific works or recordings. Until published allocation rules and statements exist, an artist should treat a private copying amount as an unverified possibility, not as a line of earned income.<\/p>\n

The documents that would settle it<\/h2>\n

The next meaningful disclosure is concrete: an implementing order that identifies covered products and the calculation method; customs records or BUBEDRA accounts showing assessed and received amounts; and a distribution rule stating how authors, performers and producers are identified and paid. The 2015 decree already specifies a transfer from customs to BUBEDRA and a customs deduction. A published reconciliation of those two flows would show whether that legal design is operating. A beneficiary statement would show whether the money completes the journey.<\/p>\n

The wider regional directive does not fill those gaps automatically. The 2026 CISAC-led study<\/a> records a 2023 West African Economic and Monetary Union (UEMOA) directive on harmonising private copying remuneration. La Nation’s July 2026 report<\/a> says the Cotonou workshop was working through its national application. A common legal direction is helpful; a musician is paid only when a national collection and distribution process can be audited.<\/p>\n

For now, the honest catalogue note is narrow. Benin has a statutory private copying entitlement and a 2015 decree that sketches a rate and customs route. The 2026 CISAC assessment and July implementation reporting do not establish a functioning, publicly documented payout chain. Rights holders should keep their authorship, performer and master ownership records complete so they can make a claim when rules and statements appear. They should ask for the order, the receipts and the distribution method before booking any levy income.
