Sony Music and DSW jointly dismissed a lawsuit over recordings used in the retailer\u2019s social media promotions<\/a>. That ends the identified dispute, but it does not tell another advertiser what it may do with the same recordings. For an independent label, the useful question is narrower: what permission covers the particular recording, campaign and channel now under consideration?<\/p>\n

Three filings, three different positions<\/h2>\n

The verb in a court update matters. In the DSW dispute, both parties jointly dismissed the lawsuit, and the settlement terms were undisclosed<\/a>. A label outside that agreement cannot use the dismissal to calculate a fee or identify a permitted use. It can establish only that the parties ended that case.<\/p>\n

In a separate copyright suit, three songwriters asked to dismiss their claim nearly four months after filing it<\/a>. That describes an action by the claimants. It supplies no terms for another songwriter assessing a similar claim and no permission for a prospective user of music. Treating either dismissal as a public licensing template would require information the filings do not provide.<\/p>\n

Suno, meanwhile, asked a court to dismiss claims brought by Jason Isbell and David Lowery, arguing that references to artists in music prompts are protected speech<\/a>. That is a defendant\u2019s argument and a request for a ruling, not a dismissal. The argument concerns references in prompts. It should not be stretched into an answer about permission to use a recording in an advertisement.<\/p>\n

These distinctions give a rightsholder a practical first step. Before changing a clearance policy because of a lawsuit, identify who made the filing, what conduct the dispute concerns and whether the court has acted. A request from a claimant, a joint dismissal and a defendant\u2019s request each convey different information. None, by its label alone, sets the terms of the next licence.<\/p>\n

Match the permission to the use<\/h2>\n

The DSW dispute concerned recordings in a retailer\u2019s social media promotions<\/a>. A label reviewing a proposed promotion can turn that fact pattern into a concrete clearance question: which recording will appear, who will publish the post, and what promotional use does the agreement authorize? The answers need to come from the agreement for that campaign. The fact that another dispute ended cannot fill a gap in it.<\/p>\n

The Suno motion calls for a different review. Its stated argument addresses artist references in music prompts<\/a>. A prompt, a generated result and a recording supplied for a campaign are different objects to examine. If a business proposes more than one of those activities, the label should record a separate decision for each. Accepting an argument about the words entered into a prompt would not, on its own, describe what happened to a recording or define how a result may be used.<\/p>\n

The same discipline applies when a songwriter considers a claim. A group of three songwriters sought dismissal of its copyright lawsuit<\/a>, but the act of withdrawing a case supplies no measure of another claim\u2019s value. The songwriter still needs to identify the work at issue, the alleged use and the outcome sought before deciding whether to pursue a dispute. The procedural result in someone else\u2019s case cannot make those choices.<\/p>\n
