{"id":8813,"date":"2026-07-27T13:25:00","date_gmt":"2026-07-27T13:25:00","guid":{"rendered":"https:\/\/interspacemusic.com\/blog\/rike-urges-due-process-after-kecobo-suspends-kamp-licence\/"},"modified":"2026-07-27T13:25:00","modified_gmt":"2026-07-27T13:25:00","slug":"rike-urges-due-process-after-kecobo-suspends-kamp-licence","status":"publish","type":"post","link":"https:\/\/interspacemusic.com\/blog\/rike-urges-due-process-after-kecobo-suspends-kamp-licence\/","title":{"rendered":"RIKE Urges Due Process After KECOBO Suspends KAMP Licence"},"content":{"rendered":"<p>The Recording Industry of Kenya (<strong>RIKE<\/strong>) has called on the <a href=\"https:\/\/www.copyright.go.ke\">Kenya Copyright Board<\/a> (<strong>KECOBO<\/strong>) to observe due process in its oversight of collective management organisations (<strong>CMOs<\/strong>), following the regulator&#8217;s decision to suspend the operating licence of the Kenya Association of Music Producers (<strong>KAMP<\/strong>).<\/p>\n<p>The suspension, announced in a public notice on 1 July 2026, halts KAMP&#8217;s operations for 90 days. RIKE, which represents record producers, record companies and self-releasing artists, warned that the move could disrupt the administration of sound recording rights held by local and international rightsholders whose works are managed through KAMP.<\/p>\n<h2>Licence Transfer Authority Questioned<\/h2>\n<p>RIKE also challenged KECOBO&#8217;s directive to transfer KAMP&#8217;s licensing functions to another CMO. The association argued that neither the Copyright Act nor the Copyright Regulations 2020 empower the regulator to reassign mandates that rightsholders have voluntarily granted to their chosen organisations. Such mandates, RIKE said, stem from contractual relationships and are fundamental to the management of private intellectual property rights.<\/p>\n<h2>Transparency and Past Interventions<\/h2>\n<p>While acknowledging KECOBO&#8217;s statutory oversight role, RIKE insisted that regulatory interventions must comply with the law and follow due process, including fair and impartial engagement with affected CMOs. The association criticised KECOBO for publicly raising allegations of financial misconduct without, it claimed, first presenting them directly to KAMP, and called for greater transparency and objectivity.<\/p>\n<p>RIKE further pointed to previous regulatory actions involving KAMP, alleging that the organisation&#8217;s licence had been withdrawn on questionable grounds and that the administration of sound recording rights had subsequently been transferred to a CMO that, according to the association, lacked sufficient representation and mandates.<\/p>\n<h2>Revenue Decline and Constitutional Rights<\/h2>\n<p>The association said prolonged regulatory intervention had contributed to declining performance rights revenues and reduced royalty distributions for record producers and artists, though it did not provide supporting figures. RIKE also expressed concern about regulatory measures that it described as attempts to enforce a &#8216;Consent&#8217; arrangement through tariff mapping, which could undermine the interests of sound recording owners.<\/p>\n<p>RIKE maintained that KAMP should be able to administer rights in areas including broadcasting, communication to the public and public performance without being compelled into arrangements that could compromise sound recording rights. It also called for any arrangements involving the eCitizen platform to ensure fair, transparent and equal cooperation between CMOs, with safeguards for all music rightsholders.<\/p>\n<p>Reiterating that copyright is fundamentally a private right, RIKE argued that rightsholders should retain the ability to determine how and by whom their rights are collectively administered. Interference with that autonomy, it said, raises questions about the constitutional protection of intellectual property under Article 40 of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Constitution_of_Kenya\">Kenya&#8217;s 2010 Constitution<\/a> and could create uncertainty for the recording industry and wider creative economy.<\/p>\n<blockquote><p>&#8220;Right holders deserve regulatory certainty to ensure CMOs effectively and efficiently manage their rights, and not recurring disruptions that undermine collection and distribution of royalties ultimately causing prejudice on the very people the copyright system exists to protect,&#8221; RIKE said.<\/p><\/blockquote>\n<p>The association urged KECOBO to reconsider the directive affecting KAMP and ensure that any regulatory action is grounded in the Copyright Act and the Copyright Regulations 2020. RIKE said it remained willing to engage with the government, CMOs and other industry stakeholders to support a collective management system that complies with Kenyan law, reflects international
