Suno Owes Damages."},"content":{"rendered":"<p>On 31 July the Munich Regional Court ruled that Suno infringed copyright in works represented by GEMA, Germany&#8217;s authors&#8217; society. The case number is 42 O 763\/25, and it is the first substantive European judgment on training a generative music model.<\/p>\n<p>The dispute ran on six songs: &#8220;Rasputin,&#8221; &#8220;Daddy Cool,&#8221; &#8220;Mambo No. 5,&#8221; &#8220;Forever Young,&#8221; &#8220;Big in Japan&#8221; and &#8220;Atemlos durch die Nacht.&#8221; GEMA demonstrated in court that Suno&#8217;s models could reproduce them from prompts combining lyrics, title and style.<\/p>\n<p>Judge Elke Schwager, who also decided GEMA&#8217;s November 2025 case against OpenAI, presided. <a href=\"https:\/\/musically.com\/2026\/07\/31\/german-collecting-society-gema-wins-its-copyright-infringement-lawsuit-against-suno\/\">Music Ally reported<\/a> the court granted GEMA injunctive relief, disclosure and damages.<\/p>\n<h2>What the court actually held<\/h2>\n<ul>\n<li><strong>Memorization counts as reproduction.<\/strong> The court found the works &#8220;reproducibly contained&#8221; in Suno v3.5 and v4, which it treated as copying under Section 16 of German copyright law.<\/li>\n<li><strong>Coincidence was ruled out.<\/strong> Schwager wrote that given the complexity and length of the pieces, randomness as the cause of playback could be excluded.<\/li>\n<li><strong>The TDM exception did not apply.<\/strong> TDM means text and data mining, the Section 44b carve-out that permits automated analysis of protected material. The court declined to extend it here.<\/li>\n<li><strong>Liability sits with the provider, not the user.<\/strong> Per <a href=\"https:\/\/www.reedsmith.com\/our-insights\/blogs\/viewpoints\/102nfis\/gema-notches-a-second-transatlantic-ai-copyright-win-in-germany\/\">Reed Smith&#8217;s analysis<\/a>, more than 100 prompt iterations did not break the chain of attribution back to Suno.<\/li>\n<li><strong>Damages are not yet quantified.<\/strong> Suno must disclose revenue from the disputed uses first. The judgment is appealable.<\/li>\n<\/ul>\n<p>Suno said the decision &#8220;rests on a fundamental mischaracterization of how Suno&#8217;s technology works&#8221; and that it is evaluating all options, including appeal.<\/p>\n<h2>The finding that travels: offshore training is not a safe harbour<\/h2>\n<p>The training happened in the United States. The court took jurisdiction anyway, routing through Section 131 of Germany&#8217;s collecting societies act.<\/p>\n<p>Read the caveat carefully. That statutory route is available to a collective management organisation, not to an individual rightsholder. CMO means collective management organisation, the body that licenses and collects on behalf of writers and publishers.<\/p>\n<p>For an indie writer or publisher, the practical consequence is unglamorous: your access to this precedent runs through society membership and correctly claimed works, not through your distributor&#8217;s legal department.<\/p>\n<h2>A licensing market is being priced at the same time<\/h2>\n<p>Eight days before the verdict, GEMA launched PLAI, a cleared dataset for AI training. <a href=\"https:\/\/www.musicbusinessworldwide.com\/as-gema-awaits-its-suno-copyright-verdict-the-german-collecting-society-launches-plai-a-fully-licensed-dataset-for-training-ai-music-tools\/\">Music Business Worldwide<\/a> put it at roughly 178,000 sound files across more than 60 genres, bundling publishing and master rights with metadata. First customer: Klangio, a German audio-to-notation tool.<\/p>\n<p>Set that against supply. <a href=\"https:\/\/newsroom-deezer.com\/2026\/07\/ai-music-exceeds-50-percent-daily-uploads-deezer\/\">Deezer said in July<\/a> that fully AI-generated tracks passed 50% of daily uploads, near 90,000 a day on peak days in June.<\/p>\n<p>So the volume of machine-made catalogue is compounding while the legal cost of unlicensed training in Europe just rose. The gap between those two lines is where a licensed dataset gets its price.<\/p>\n<h2>What a label should do this month<\/h2>\n<ul>\n<li><strong>Audit your CMO registrations.<\/strong> The Munich route only reaches repertoire a society can prove it represents. Unclaimed works sit outside it.<\/li>\n<li><strong>Write down an AI training position per catalogue.<\/strong> Opt-in licensing pays. A blanket refusal is also a valid stance, but it has to be recorded somewhere a machine can read.<\/li>\n<li><strong>Declare AI involvement in delivery metadata.<\/strong> DDEX means Digital Data Exchange, the standard your release travels on. Its AI disclosure fields are now acted on by DSPs, as we covered when <a href=\"https:\/\/interspacemusic.com\/blog\/tidal-stopped-paying-ai-music-on-july-15-the-field-that-decides-if-you-get-paid-now-lives-in-your-delivery\/\">TIDAL stopped paying fully AI tracks in July<\/a>.<\/li>\n<li><strong>Keep authorship evidence.<\/strong> Session files, stems, dated exports. Disclosure disputes are won on records, not assertions.<\/li>\n<\/ul>\n<p>InterSpace Distribution ships DDEX-native deliveries with those disclosure fields populated at source rather than patched after a takedown, and reports splits per contributor in the artist royalty dashboard. That is boring infrastructure until the month a DSP starts filtering on it.<\/p>\n<p>The judgment is not final and Suno will likely appeal. But the direction is now set for the European market, and it is the same direction the <a href=\"https:\/\/interspacemusic.com\/blog\/the-human-premium-ai-lyrics-and-the-fight-for-musics-soul\/\">human premium argument<\/a> has been pointing at all year.
