RBX has appealed the dismissal of his lawsuit alleging that Spotify selectively enforces its rules against fraudulent streams. The case concerns his claim that bot-driven plays have diverted royalties from artists outside major labels.
RBX, whose real name is Eric Collins, filed a notice of appeal with the Ninth Circuit. The Long Beach-born rapper’s main appellate filing has not yet appeared on the docket.
In an amended complaint filed over the summer, Collins accused Spotify of aggressively detecting manipulation on independent releases while failing to curb fraudulent activity involving prominent artists, including Drake. His suit alleged that more than $600 million in royalties had been diverted.
Judge Josephine Staton dismissed the case with prejudice last month, finding that Collins had “failed to plausibly allege that Spotify has an undisclosed selective [anti-fraud] enforcement policy.” She described the claim that Spotify chose to enforce its existing measures against some artists but not others as “entirely conclusory and unsupported.”
