Morocco Has Three Music Rights Claims. One ISRC Registers Only the Recording.

Morocco music royalties require more than one upload. BMDAV keeps separate records for the song, the performers and the phonogram producer; an ISRC identifies only the recording. This guide shows Moroccan artists and labels how to reconcile all three claims before release.

A Moroccan artist who writes, sings and finances a recording may have three different claims in the same release. The practical rule is simple: record the song, the performance and the master under the correct names. Uploading the audio to a distributor documents only part of that chain.

The Bureau Marocain des Droits d’Auteur et Droits Voisins (BMDAV), Morocco’s collective rights body, makes the distinction visible in its own paperwork. It offers a musical-work declaration for authors and separate neighbouring-rights files for performers and sound-recording producers. A singer who also wrote the topline and owns the recording should check all three roles.

One release, three different claims

The composition is the melody and lyrics. Its file needs the writers and their agreed shares; the recording does not automatically establish who wrote the song. BMDAV’s author documents include a specific declaration for a musical work, rather than a generic recording upload.

The performance is the singer’s or instrumentalist’s contribution to a recording. BMDAV lists separate supporting documents for singers, musicians and choristers, and its discography page distinguishes the performing artist’s catalogue from the phonogram producer’s. A featured vocalist and a hired session player therefore need credits that identify their actual roles, not an all-purpose “artist” field.

The phonogram is the recorded master. Its producer, in this rights context, is the person or company claiming the sound-recording right; that may be a self-releasing artist or a label. BMDAV’s neighbouring-rights checklist even separates a natural-person sound-recording producer from a company, so the name on the claim should match the entity that owns the master.

Why the ISRC does not finish the job

ISRC means International Standard Recording Code. IFPI’s ISRC agency says it identifies a sound recording, not its composition or lyrics. An ISRC can help reconcile the master across releases and services, but it is not a writer declaration and does not prove that a session musician was credited.

That distinction matters because Spotify describes recording and publishing royalties as separate streams. The service’s explanation is global, not a statement of BMDAV’s individual licensing deals. For a Moroccan catalogue, a clean distributor statement should be compared with the author and neighbouring-rights registrations, not mistaken for either of them.

BMDAV says it receives affiliation files and declarations for works and performances, and represents Moroccan rights through agreements with foreign societies. That is the society’s stated mandate, not a guarantee that every play abroad is matched or paid. A rights claim still depends on accurate repertoire data and the agreements that cover the use.

Build one reconciliation sheet before release

Give each track one row with its title, ISRC, master owner, writer names and agreed shares, performer credits, and the corresponding BMDAV submission or acknowledgement for each applicable role. Keep producer contracts and session agreements beside it. BMDAV publishes singer, studio and producer attestations, which is a useful warning that a credit dispute may need evidence beyond a platform profile.

Then test the row against three questions: Who wrote the work? Who performed on the master? Who owns the sound recording? If one answer is blank, ask the relevant collaborator before delivery, while the paperwork is still easy to correct. A label with dozens of releases should make this check part of intake, alongside audio and artwork.

We previously mapped Morocco’s copyright reform and the recording-income distinction, and the market split between Moroccan and overseas listeners. The operational lesson is narrower: regional distribution gets the master to services, while complete rights records give each contributor a clearer route to the money attached to that use. Ask any distributor how its dashboard maps recording income to the owner and how it preserves the credits needed for the other claims.
